General Terms and Conditions of Sale
1. Introduction
These General Terms and Conditions of Sale (the "Terms") govern the sale of toys and furniture for babies and kids (the "Products") by Petit BAEM (the "Seller") through its e-shop (the "Website"). By placing an order on the Website, you ("Customer") agree to be bound by these Terms. Please read them carefully before making a purchase.
2. Orders and Acceptance
2.1. Product Information: The Seller provides accurate and detailed information about the Products on the Website, including descriptions, prices, and availability. However, minor variations may occur, and the Seller reserves the right to update or modify the Product information without prior notice.
2.2. Placing an Order: The Customer may place an order by following the online ordering process on the Website. By submitting an order, the Customer makes an offer to purchase the selected Products under these Terms.
2.3. Order Confirmation: The Seller will send an order confirmation email to the Customer once the order has been received. This confirmation does not constitute acceptance of the order but serves as an acknowledgment of receipt.
2.4. Order Acceptance: The Seller reserves the right to accept or decline an order at its sole discretion. Order acceptance occurs when the Seller dispatches the Products to the Customer and provides a shipment confirmation email. The contract of sale is formed at this point.
3. Prices and Payment
3.1. Pricing: All prices displayed on the Website are in the applicable currency and inclusive of any applicable taxes, unless otherwise stated. The Seller reserves the right to adjust prices at any time, but the Customer will be charged the price stated at the time of order confirmation.
3.2. Payment Methods: The Seller accepts payment by the methods specified on the Website. Payment must be made in full at the time of placing the order. The Seller may withhold the Products until full payment has been received.
4. Shipping and Delivery
4.1. Shipping: The Seller will ship the Products to the address provided by the Customer during the ordering process. The Customer is responsible for providing accurate and complete shipping information.
4.2. Delivery Times: The Seller aims to deliver the Products within the estimated delivery times mentioned on the Website. However, these times are approximate and may vary due to factors beyond the Seller's control. The Seller will not be liable for any delays or consequential damages arising from delayed delivery.
4.3. Shipping Costs: Shipping costs, if applicable, will be displayed during the ordering process. The Customer is responsible for all shipping costs, unless stated otherwise.
5. Returns and Refunds
5.1. Right of Withdrawal: The Customer has the right to withdraw from the contract within 14 days, starting from the day after the Customer receives the Products. The Customer must notify the Seller of their intention to withdraw and follow the return instructions provided by the Seller, see shipping, exchange and/or return.
5.2. Return Conditions: The Products must be returned in their original condition and packaging, unused and undamaged. The Seller reserves the right to refuse returns that do not comply with these conditions.
5.3. Refunds: Upon receiving the returned Products in compliance with these Terms, the Seller will issue an online store credit to the Customer within a reasonable time. This store credit can be used for future purchases on the Website. Please note that no cash refunds will be provided for returned items.
5.4. Discounted Items: When returning a discounted item, the Customer will not receive a refund in cash but rather an online store credit, which can be used for future purchases.
6. Limitation of Liability
To the maximum extent permitted by law, Petit BAEM shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the purchase, use, or inability to use the Products or any issues related to the Website.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
8. Modifications
Petit BAEM reserves the right to modify these Terms at any time, without prior notice. The updated Terms will be posted on the Website, and it is the Customer's responsibility to review them before placing an order.
